U.S. STATE SUPPLEMENTAL PRIVACY NOTICE
Effective Date: June 1, 2024
This U.S. State Supplemental Privacy Notice supplements our Higher Health Foundation Privacy Policy and describes information practices relating to California, Colorado, Connecticut, Utah, and Virginia residents. If you interact with Higher Health Foundation as a consumer, customer, or business-to-business contact, please visit the section titled “Consumer Privacy Notice”.

This Consumer Privacy Notice (“Consumer Notice”) supplements our Higher Health Foundation Privacy Policy and describes how Higher Health Foundation, Inc. B. Submitting Requests Relating to Your Personal Information

C. Verification Process
Once we receive a request to know, correct, or to delete, we must verify your identity before we can respond.
You may be required to provide the following information for verification purposes:

D. Authorized Agent
If you are a California resident, you may use an authorized agent to submit a request to know, to correct, to delete, to limit, or to opt out. You may make such a designation by providing the agent with written permission to act on your behalf. We will require the authorized agent to provide either (1) a power of attorney; or (2) proof of your written permission. In addition to proof of your written permission, we may require you to verify your own identity and directly confirm that you provided the agent permission to submit the request. An authorized agent is either a natural person or a business entity registered with the California Secretary of State that a consumer has authorized to act on his or her behalf.

If you are a Colorado resident, you may use an authorized agent (a person or entity acting on your behalf) to submit a request to opt-out out of our processing of Personal Information for the purposes of targeted advertising, selling, or profiling. You may make such a designation by providing the agent with written permission to act on your behalf. We will require the authorized agent to provide either (1) a power of attorney; or (2) proof of your written permission. In addition to proof of your written permission, we may require you to verify your own identity and directly confirm that you provided the agent permission to submit the request.
E. Your Privacy Rights
Depending on your state of residency, you may be able to exercise certain privacy rights related to the Personal Information we maintain.

Right to Access and Data Portability Personal Information. A copy of the specific pieces of Personal Information we have collected about you. You may also request that we send a copy of the Personal Information you provided to us in a portable format.

Right to Delete Your Personal Information. You have the right to request that we delete Personal Information we collected from you, subject to certain exceptions.
Right to Correct Inaccurate Information. If you believe that the Personal Information we maintain about you is inaccurate, you have the right to request that we correct that information.
Right to Opt-Out of Sales of Personal Information and Sharing for Targeted Advertising. You have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for targeted or cross-context behavioral advertising. Some of the ways we use tracking technologies for advertising and marketing may be considered a “sale” or “share” and may allow you the right to opt out of this use of your Personal Information. If you wish to opt out of the offline sale of your Personal Information, you may submit an opt-out request by emailing info@higherhealthfoundation.org You may also opt out of targeted advertising / non-monetary “sales” of Personal Information through an opt-out preference signal, such as the Global Privacy Control. If you choose to use a browser-based opt-out signal, you will need to turn it on for each browser you use.

Right to Limit Use and Disclosure of Sensitive Personal Information (California Only). We do not use or disclose Sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the California privacy law.

Right to Appeal (Colorado and Connecticut Only). Sometimes we are unable to process requests relating to your Personal Information, in which case, your request will be denied. If you believe that we have denied your privacy rights request in error, you may appeal for reconsideration of your request using our web form or toll-free phone number.
Right to Non-Discrimination for the Exercise of Your Privacy Rights. You will not receive discriminatory treatment from us if you choose to exercise any of your privacy rights.
F. California’s “Shine the Light” Law
Subject to certain limits under California Civil Code section 1798.83, California residents may ask Higher Health Foundation, Inc. to provide them with (1) a list of certain categories of Personal Information that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year; and (2) the identity of those third parties. California residents may make one (1) request per calendar year.
To make this request, you may contact Higher Health Foundation, Inc. at the mail or email address listed in the “Contact Us for More Information” section below. In your request, please state that you are a California resident and provide a current California address for our response. Please allow up to thirty (30) calendar days for a response. Higher Health Foundation, Inc. reserves its right not to respond to such requests submitted to addresses other than those specified in the “Contact Us for More Information” section below.
G. Notice of Financial Incentive
At this time, we do not offer any financial incentives or price or service differences that relate to our collection, retention, or use of your Personal Information. However, if this changes, we will provide a written description of the material terms of the financial incentive or price or service difference to you in a written Notice of Financial Incentive, and you will only be enrolled as a participant if you affirmatively opt-in to the program. You may revoke your opt-in consent at any time. The Notice of Financial Incentive will explain the processes for opting-in to participate and revoking your consent (opting-out).
5. Additional Information for Utah and Virginia Residents
Terms defined in the Utah and Virginia privacy laws that are used in this Section 5 shall have the same meaning as in the applicable state laws as they apply to residents of those states.

Sales of Personal Data. We do not sell your Personal Data for monetary consideration.
B. Submitting Requests Relating to Your Personal Data
Depending on your state of residency, you may have the right to submit certain requests relating to your Personal Data as described below. To exercise any of these rights, please submit a request through our Consumer Portal, or call us at ___________.
If you choose to exercise any of the privacy rights described below, you will not receive discriminatory treatment from us. This means that we will not deny providing our products or services to you, charge you different prices, or provide a different level or quality of products or services to you unless those differences are related to the value of your Personal Data.
C. Authentication Process
Once we receive a request to know, to correct, or to delete, we must authenticate your identity before we can respond.
You may be required to provide the following information for authentication purposes:
